This Acceptable Use Policy (“Policy”) forms part of the PixoProof Terms of Service and applies to all users of the PixoProof platform, website, applications and related services (collectively, the “Services”), including Photographers, Clients and gallery recipients. Part B sets out our AI Usage Restrictions.
PixoProof may investigate any suspected violation and take any action it considers appropriate, including immediate suspension or termination of access, removal of content, and reporting to law enforcement or other authorities.
01Part A · Prohibited content
You must not upload, store, share, transmit or otherwise make available any content that:
- is illegal under any applicable law;
- constitutes child sexual exploitation or abuse material (any such material results in immediate account termination and a report to the relevant authorities);
- infringes copyright, trademark, privacy, publicity or any other intellectual property or personal right;
- is defamatory, harassing, threatening, hateful or discriminatory;
- contains malware, viruses, ransomware or other harmful code;
- promotes or facilitates illegal activity;
- depicts non-consensual intimate imagery;
- violates any applicable advertising, consumer protection or privacy law.
PixoProof does not review all content uploaded by users and accepts no responsibility for content uploaded by Photographers or Clients.
02Prohibited conduct
You must not:
- attempt to gain unauthorised access to any part of the Services, other user accounts or related systems or networks;
- circumvent, disable, interfere with or attempt to bypass any security features, access controls, watermarking, download restrictions or screenshot protections;
- share, sell, transfer or allow others to use your account credentials;
- use another person’s account without authorisation;
- conduct automated scraping, crawling, bulk downloading, data extraction or harvesting of any content;
- reverse engineer, decompile, disassemble or attempt to extract source code from the Services;
- interfere with or disrupt the integrity, security, performance or availability of the Services;
- engage in phishing, social engineering, fraud or any deceptive activity;
- use the Services to send unsolicited commercial communications or spam;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- probe, scan or test the vulnerability of the Services without prior written authorisation from PixoProof (see our responsible disclosure terms in the Security & Data Retention Policy).
03Technical protection measures
You must not attempt to bypass, remove or interfere with watermarks, screenshot protections, download controls or any other technical protection measure applied to galleries or content, or use external cameras, screen-recording software, browser extensions or other methods to capture protected content in violation of the Photographer’s settings or these terms.
PixoProof does not guarantee that technical protections will prevent all forms of unauthorised copying or recording. These features are risk-reduction tools only.
04Part B · AI Usage Restrictions — scope
These restrictions protect the intellectual property and privacy rights of Photographers and the people depicted in images, prevent unauthorised use of content for AI training, model development or data harvesting, and make clear that no right to use platform content for AI purposes is granted. They apply to all photographs, images, galleries, metadata and other content on or through the Services; to any use of artificial intelligence, machine learning, deep learning, generative AI, facial recognition or similar technologies; and to all users, automated systems, bots, scripts and third-party tools that interact with the Services.
05Prohibited AI-related activities
Users must not, without the express prior written permission of the relevant rights holder:
- use any content from the platform for AI or machine learning training;
- create, compile or contribute to datasets using platform content;
- scrape, crawl, bulk-download or extract content for AI purposes;
- use platform content to develop, train, fine-tune or evaluate AI models;
- perform facial recognition, biometric analysis or similar processing on images;
- use generative AI tools to create derivative works from platform content in a way that infringes rights;
- feed platform content into any AI system for commercial or research purposes;
- use automated tools to harvest images, metadata or user information for AI-related activities.
These restrictions apply whether the activity is carried out manually or through scripts, bots, browser extensions, APIs or any other means.
Rights and permissions
Ownership of content remains subject to the arrangements between the Photographer and their Client (or other rights holders). PixoProof does not own the content and does not grant any AI-related rights on behalf of Photographers or any other party. No general or implied licence for AI training, data harvesting or similar uses is granted by uploading content to PixoProof or by accessing a gallery.
No AI training by PixoProof
PixoProof does not use user-uploaded content to train any AI models. Content is processed only as necessary to operate, secure and provide the Services, including hosting, delivery, resizing, watermarking and encrypted database backups. Photo files themselves are not copied into backups.
06Enforcement
PixoProof reserves the right, at its sole discretion, to remove or disable access to any content that violates this Policy; block or throttle automated access; suspend or terminate accounts immediately and without prior notice where reasonably necessary; report suspected illegal activity (including child exploitation material) to the appropriate authorities; and take any other action it considers necessary to protect the Services, its users, rights holders or third parties.
Repeated or serious violations result in permanent termination of access. Violations may also lead to legal action by PixoProof or affected rights holders.
07No liability for user content or conduct
PixoProof is a technology platform only. PixoProof is not responsible for any content uploaded by users or for any conduct of Photographers or Clients. All responsibility for content and user behaviour remains with the relevant user.
08Reporting violations
If you become aware of any content or activity that violates this Policy, report it promptly to [email protected]. Reports are reviewed and appropriate action taken.
09Changes to this Policy
We may update this Policy to reflect changes in our practices, technology or legal requirements. The version number and “Last updated” date at the top show when the most recent changes were made.
