PixoProof respects the intellectual property rights of others and expects all users of the PixoProof platform, website, applications and related services (collectively, the “Services”) to do the same.
PixoProof is a technology platform only. PixoProof does not own, create or control any photographs or content uploaded by Photographers. All photographs and content on the Services remain the property and responsibility of the Photographer who uploaded them. This Policy explains how PixoProof handles notices of claimed copyright infringement and sets out the process for notices and counter-notices. Notices in the form required by the United States Digital Millennium Copyright Act (DMCA) are accepted.
01Reporting copyright infringement
If you believe that content on the Services infringes your copyright, send a written notice to [email protected] with “Copyright Infringement Notice” in the subject line. Your notice must include:
- a physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
- identification of the copyrighted work claimed to have been infringed (or a representative list if several works are covered by one notice);
- identification of the material claimed to be infringing, with information reasonably sufficient for PixoProof to locate it (for example the gallery link or specific image file names);
- your contact information, including name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of the exclusive right allegedly infringed.
Notices that do not substantially comply with these requirements may be rejected. We aim to acknowledge complete notices within two business days.
02Action on valid notices
On receipt of a valid notice, PixoProof will promptly remove or disable access to the allegedly infringing material, take reasonable steps to notify the user who uploaded it, and document the notice and the action taken. PixoProof may also remove content and suspend or terminate accounts at its discretion where it has reason to believe infringement has occurred, even without a formal notice.
03Counter-notice procedure
If your content has been removed or disabled as a result of a copyright notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice to the same address. Your counter-notice must include:
- your physical or electronic signature;
- identification of the material that was removed or disabled and the location at which it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, postal address, telephone number and email address;
- a statement that you consent to the jurisdiction of the courts of Victoria, Australia (or, for United States residents, the federal district court for your judicial district), and that you will accept service of process from the person who submitted the original notice or their agent.
On receipt of a valid counter-notice, PixoProof will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action seeking to restrain the activity, PixoProof may restore the material at its discretion.
04Repeat infringer policy
PixoProof terminates, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. Factors that may lead to termination include multiple valid infringement notices, failure to respond to notices or counter-notices, and clear patterns of infringing activity. PixoProof may terminate accounts at its sole discretion where it reasonably believes the user has engaged in repeated or wilful infringement.
05Content removal rights
PixoProof reserves the right, at any time and at its sole discretion, to remove or disable access to any content it believes may infringe copyright or other rights, to suspend or terminate associated accounts, and to take any other action it considers necessary to protect the rights of copyright owners, the Services or third parties. PixoProof is under no obligation to restore content removed under this Policy.
06Photographer responsibility
Photographers are solely responsible for ensuring that all content they upload does not infringe any third-party copyright or other intellectual property rights. PixoProof does not review content for copyright ownership and accepts no liability for any infringement arising from content uploaded by users.
07Misrepresentation
Any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and legal fees, under applicable law (including 17 U.S.C. § 512(f) where applicable).
08Other intellectual property claims
While this Policy focuses on copyright, PixoProof also respects other intellectual property rights and will review such claims and take appropriate action at its discretion.
09Changes to this Policy
PixoProof may update this Policy from time to time. The version number and “Last updated” date at the top show when the most recent changes were made.

Version history: 1.0 (1 September 2026) first release. 1.1 (8 October 2026) retitled to Copyright & Takedown Policy because PixoProof has not registered a DMCA agent with the US Copyright Office; DMCA-form notices are still accepted. Added an acknowledgement target, a fixed 10-business-day counter-notice window and the US jurisdiction wording for US residents. Effective date aligned with the other policies.
